Data Privacy Agreement

A Data Privacy Agreement (DPA) is a binding legal contract between Classwire, LLC and your school. It governs how we handle student data and ensures we meet the requirements of FERPA, COPPA, the Texas Student Privacy Act, and TDPSA.

The DPA makes Classwire a "school official" under FERPA with strict limits on how we can use student data. It's the document that gives schools confidence their data is protected.

Schools and preschools that will use Classwire to manage student records, attendance, progress tracking, or any other student data should have a signed DPA on file before enabling student data features.

Independent teaching consultants who use Classwire for their own classes are generally covered by our Terms of Service and Privacy Policy. However, if you handle student data on behalf of a school, you should also have a DPA in place.

Our DPA template is based on the NDPA/Texas Student Privacy Alliance format and covers:

• Data use restrictions — Student data used for educational purposes only; no sale, profiling, or secondary commercial use
• Data security — Encryption, access controls, and security practices we maintain
• Breach notification — 60-day notification timeline per Texas law
• Data retention & deletion — Data deleted upon request or termination, with certification of destruction
• Sub-processors — List of third-party services that access data, with same obligations
• Parental access — Schools facilitate; Classwire supports
• Audit rights — Schools may request compliance documentation
• Term & termination — Aligned with service agreement, with data obligations surviving termination

We will countersign and return a fully executed copy for your records. The DPA should be on file before enabling student data features in Classwire.
